Terms of Service for DriveTracker

Agreement to Terms

By downloading, installing, or using the DriveTracker mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

DriveTracker is a location tracking and route recording application designed for drivers. The App provides the following features:

Free Features

  • Route recording (start, stop, pause, resume)
  • Real-time location tracking
  • Route history visualisation on maps
  • Basic route sharing capabilities
  • Apple Watch support
  • Widget support
  • Siri and Shortcuts integration

Premium Features

Premium subscribers gain access to additional features:

  • Detailed driving statistics (distance, speed, time)
  • Advanced analytics and reports (daily, weekly, monthly, yearly)
  • CSV data export
  • Ad-free experience
  • Multi-device iCloud synchronisation
  • Priority customer support

User Account

Anonymous Authentication

  • DriveTracker uses Firebase Anonymous Authentication
  • No personal information (name, email, password) is required to use the App
  • A unique anonymous identifier is assigned to your device
  • Account data may be lost if you uninstall the App or clear app data

Future Account Migration

  • We may offer full account registration in the future
  • Anonymous users will have the option to migrate their data to a full account

Licence

Grant of Licence

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

  • Download and install the App on devices you own or control
  • Use the App for personal, non-commercial purposes

Restrictions

You agree NOT to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices from the App
  • Use the App for any illegal or unauthorised purpose
  • Attempt to gain unauthorised access to any portion of the App
  • Use the App in any way that could damage, disable, or impair the App
  • Use the App to harass, abuse, or harm another person
  • Sell, rent, lease, or sublicence the App
  • Use the App to collect location data of others without their consent
  • Use automated systems or software to extract data from the App

Location Services

Required Permission

  • The App requires "Always Allow" location permission to function properly
  • Background location tracking is essential for continuous route recording
  • You can revoke location permission at any time through iOS Settings, but this will disable core App functionality

Responsible Use

You agree to:

  • Only track your own location and routes
  • Not use the App to track other individuals without their explicit consent
  • Comply with all local laws and regulations regarding location tracking
  • Use the App safely and not whilst actively driving (unless using hands-free features)

Premium Subscriptions and Purchases

Subscription Plans

DriveTracker offers the following premium options:

  1. Monthly Subscription: Auto-renewing monthly subscription with free trial period
  2. Annual Subscription: Auto-renewing annual subscription with free trial period (discounted compared to monthly)
  3. Lifetime Licence: One-time purchase providing permanent access (no subscription required)

All plans support Family Sharing. Pricing varies by region and is displayed in the App Store and within the App. Prices are subject to change.

Free Trial

  • New subscribers may access a 7-day free trial for subscription plans
  • You will not be charged during the trial period
  • Your subscription will automatically begin after the trial ends unless you cancel
  • Only one free trial per Apple ID

Automatic Renewal

  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings

Cancellation

  • You may cancel your subscription at any time through your Apple ID Account Settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods
  • You will retain premium access until the end of your paid period

Lifetime Licence

  • One-time purchase providing permanent access to premium features
  • Non-refundable after purchase (subject to Apple's refund policy)
  • Valid for the lifetime of the App (as long as the App is available)

Price Changes

  • We reserve the right to change subscription prices at any time
  • Price changes will not affect existing subscribers during their current billing period
  • New prices will apply upon subscription renewal

Refunds

  • All purchases are processed through Apple's App Store
  • Refund requests must be made through Apple, not directly to us
  • We do not have access to process refunds for App Store purchases
  • Refund eligibility is determined by Apple's policies

Family Sharing

  • All premium plans support Apple Family Sharing
  • One subscription can be shared with up to 5 family members
  • Family organiser is responsible for all charges

Data and Privacy

Your Data

  • You retain all rights to your location data and route records
  • Data is stored locally on your device and optionally in your personal iCloud account
  • We do not store your location data on our servers

Data Backup

  • You are responsible for backing up your data
  • We recommend enabling iCloud sync for data backup
  • We are not responsible for data loss due to device failure, app deletion, or other circumstances

Data Export

  • Premium users can export their data in CSV format
  • Exported data remains your property
  • You may use exported data for personal purposes only

Intellectual Property

Our Content

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by DriveTracker, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks

DriveTracker name and logo are our trademarks. You may not use these trademarks without our prior written permission.

Feedback

If you provide us with any feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without any obligation to you.

Third-Party Services

The App integrates with the following third-party services:

  • Apple Services: iCloud, StoreKit, MapKit, App Store
  • Firebase: Analytics, Authentication
  • Google Maps: Map data (via MapKit)

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services.

Prohibited Uses

You may not use the App to:

  • Violate any local, state, national, or international law
  • Infringe upon or violate our intellectual property rights
  • Harass, abuse, insult, harm, defame, or intimidate any person
  • Submit false or misleading information
  • Interfere with or circumvent security features of the App
  • Engage in any automated use of the system
  • Attempt to impersonate another user or person
  • Use the App for any commercial solicitation purposes

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of location data
  • Uninterrupted or error-free operation
  • Security of data transmission

We do not warrant that:

  • The App will meet your requirements
  • The App will be available at any particular time or location
  • Any defects or errors will be corrected
  • The App is free of viruses or other harmful components
  • Location data will always be accurate
Important: DriveTracker is designed to track routes and should not be used as a primary navigation tool whilst driving. Always prioritise road safety.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DRIVETRACKER, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OR EMPLOYEES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Loss of or damage to property
  • Personal injury or property damage
  • Any damages arising from your use or inability to use the App

This applies whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR PREMIUM FEATURES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

Indemnification

You agree to defend, indemnify, and hold harmless DriveTracker and its affiliates from any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any applicable laws

Safety Warning

Critical Safety Notice:
  • DO NOT operate the App whilst actively driving
  • Use hands-free features (Siri, widgets) only when safe to do so
  • Always comply with traffic laws and regulations
  • DriveTracker is not a substitute for professional navigation systems
  • We are not liable for accidents, injuries, or damages resulting from App use whilst driving
  • The App is for route tracking purposes only, not real-time navigation

Changes to the App

We reserve the right to:

  • Modify or discontinue the App (or any part thereof) at any time
  • Change features, functionality, or availability
  • Impose limits on certain features
  • Restrict access to parts or all of the App

We are not liable to you or any third party for any modification, suspension, or discontinuance of the App.

Geographic Restrictions

  • The App is available globally in 15 languages
  • Some features may not be available in all countries
  • In-app purchases are subject to local currency and pricing
  • We make no representation that the App is appropriate or available for use in all locations

Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. We will notify you of changes by:

  • Posting the new Terms within the App
  • Updating the "Last Updated" date
  • Displaying an in-app notification for material changes

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

Termination

By You

You may stop using the App at any time by uninstalling it from your device.

By Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, if:

  • You breach these Terms
  • You engage in prohibited uses
  • We are required to do so by law
  • We decide to discontinue the App

Effect of Termination

Upon termination:

  • Your licence to use the App will immediately cease
  • You must stop all use of the App
  • Premium subscriptions will be handled according to subscription terms
  • Provisions that should survive termination will remain in effect

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles.

Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.

Arbitration

If informal resolution fails, you agree that any dispute shall be resolved through binding arbitration in accordance with the rules of the Japan Commercial Arbitration Association.

Class Action Waiver

You agree to resolve disputes on an individual basis only, and not as part of any class, consolidated, or representative action.

Apple-Specific Terms

App Store Requirements

  • These Terms are between you and DriveTracker, not Apple
  • Apple has no responsibility for the App or its content
  • Apple has no warranty obligation for the App
  • Apple is not responsible for maintenance or support
  • Apple is not liable for any claims related to the App

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DriveTracker regarding the App and supersede all prior agreements.

BY USING DRIVETRACKER, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
