ProjectCam Terms of Use

Agreement to Terms

By downloading, installing, or using the ProjectCam mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

ProjectCam is a privacy-focused, project-based camera application. It organizes captured photos and videos by project and stores all media in the app sandbox on your device. The App provides the following features:

Core Features

  • Photo and video capture using the camera
  • Project-based media management
  • Viewing and organizing captured media
  • Image editing features
  • Media sharing and export

Premium Features

Premium purchasers or rewarded ad viewers can access additional features:

  • Ad-free experience (permanent purchasers only)
  • Additional premium features
Important: Media captured in the App is not saved to the system Photos library. All data is stored in a protected area dedicated to the app and is completely deleted when you uninstall the app.

User Accounts

Anonymous Authentication

  • ProjectCam uses Firebase anonymous authentication
  • No personal information (name, email address, password) is required to use the App
  • A unique anonymous identifier is assigned to your device
  • Uninstalling the App or clearing app data may result in loss of account data

Account Deletion

  • You can delete the Firebase anonymous account by logging out within the App
  • Uninstalling the App deletes all locally stored data
  • If you change devices, a new anonymous ID will be generated (data will not be carried over)

License

License Grant

Subject to your compliance with these Terms, we grant you the following limited, non-exclusive, non-transferable, revocable license:

  • To download and install the App on devices you own or control
  • To use the App for personal, non-commercial purposes

Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove copyright or other proprietary notices from the App
  • Use the App for illegal or unauthorized purposes
  • Attempt to gain unauthorized access to any part of the App
  • Use the App in any manner that could damage, disable, or impair it
  • Use the App to harass, abuse, or harm others
  • Sell, rent, lease, or sublicense the App
  • Use automated systems or software to extract data from the App

Camera and Microphone Use

Required Permissions

  • Camera access permission is required for the App to function properly
  • Microphone access permission is required for audio recording during video capture
  • You can revoke these permissions at any time through iOS Settings, but doing so will disable the App's main features

Responsible Use

You agree to:

  • Comply with all local laws and regulations regarding photography
  • Respect the portrait rights and privacy of others
  • Not photograph others without their explicit consent
  • Not take unauthorized photos in private spaces

Premium Purchases and Rewarded Ads

Purchase Options

ProjectCam offers the following premium options:

  1. Lifetime Access Purchase: A one-time purchase that provides lifetime access to premium features
  2. Welcome Offer: A discounted lifetime access purchase for first-time users

Prices vary by region and are displayed in the App Store and within the app. Prices are subject to change.

Rewarded Ads

  • Watching ads allows you to temporarily use premium features
  • Watching rewarded ads is entirely optional
  • Ad availability depends on the Google Mobile Ads network status

Lifetime Access Purchase

  • A one-time purchase that provides lifetime access to premium features
  • Refunds after purchase are subject to Apple's refund policy
  • Valid for the lifetime of the App (as long as the App is available)
  • Purchases can be restored on devices signed in with the same Apple ID

Price Changes

  • We reserve the right to change prices at any time
  • Price changes will not affect existing purchasers

Refunds

  • All purchases are processed through Apple's App Store
  • Refund requests must be made through Apple, not directly to us
  • We do not have access to process refunds for App Store purchases
  • Refund eligibility is determined by Apple's policies

User-Generated Content

Your Content

  • You retain all rights to the photos and videos you capture
  • Content is stored locally on your device only
  • We do not access your content or store it on our servers

Content Responsibility

You bear full responsibility for the content you capture:

  • Comply with laws regarding photography
  • Do not infringe the portrait rights or copyrights of others
  • Do not capture or store illegal content
  • Do not create content related to child abuse, harassment, or threats

Data Backup

  • You are responsible for backing up your data
  • The App does not provide cloud backup functionality
  • We are not liable for data loss due to device failure, app deletion, or other circumstances
  • We recommend regularly exporting and backing up important media to other locations
Important: Uninstalling the app will permanently delete all photos, videos, and project data and cannot be restored.

Intellectual Property

Our Content

The App and all its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by ProjectCam, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks

The ProjectCam name and logo are our trademarks. You may not use these trademarks without our prior written permission.

Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without any obligation to you.

Third-Party Services

The App is integrated with the following third-party services:

  • Apple Services: StoreKit, App Store
  • Firebase: Anonymous authentication
  • Google Mobile Ads: Rewarded ad delivery

Use of these services is subject to their respective terms of use and privacy policies. We are not responsible for third-party services.

Prohibited Uses

You may not use the App for the following purposes:

  • To violate local, state, national, or international laws
  • To infringe our intellectual property rights
  • To harass, abuse, insult, harm, defame, or threaten any person
  • To take photographs that infringe the portrait rights or privacy of others
  • To create content related to child abuse, harassment, or sexual exploitation
  • To create content related to illegal drugs, weapons, or criminal activity
  • To interfere with or circumvent security features of the App
  • To engage in automated use of the system
  • To attempt to impersonate other users or persons
  • To use the App for commercial solicitation
  • To engage in fraudulent viewing of rewarded ads (e.g., spam clicking)

Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to:

  • Warranty of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of captured data
  • Uninterrupted or error-free operation
  • Storage or protection of data

We do not warrant that:

  • The App will meet your requirements
  • The App will be available at a particular time or place
  • Defects or errors will be corrected
  • The App is free of viruses or other harmful components
  • Captured data will be permanently stored

Limitation of Liability

To the maximum extent permitted by law, ProjectCam, its affiliates, licensors, service providers, or employees shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Loss or corruption of captured media
  • Data loss due to device failure or app deletion
  • Damages arising from use or inability to use the App

This applies regardless of whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you exceed the amount paid for premium features in the 12 months preceding the claim, or $100 (USD), whichever is less.

Indemnification

You agree to defend, indemnify, and hold harmless ProjectCam and its affiliates from and against all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Your use of the App
  • Violation of these Terms
  • Infringement of third-party rights
  • Violation of applicable law
  • Claims related to content you capture

Changes to the App

We reserve the right to:

  • Modify or discontinue the App (or any part of it) at any time
  • Change features, functionality, or availability
  • Impose restrictions on certain features
  • Restrict access to some or all of the App

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Geographic Restrictions

  • The App is available worldwide in over 40 languages
  • Some features may not be available in all countries
  • In-app purchases are subject to local currency and pricing
  • We make no representation that the App is appropriate or available in all locations

Changes to Terms

We may revise and update these Terms at our sole discretion from time to time. We will notify you of changes by:

  • Posting the new Terms within the App
  • Updating the "Last Updated" date
  • Displaying in-app notifications for significant changes

Continued use of the App after changes become effective constitutes your agreement to the revised Terms.

Termination

Termination by You

You may stop using the App at any time by uninstalling it from your device.

Termination by Us

We may immediately terminate or suspend your access to the App without prior notice or liability in the following cases:

  • You violate these Terms
  • You engage in prohibited uses
  • Required by law
  • We decide to discontinue the App

Effect of Termination

Upon termination:

  • Your license to use the App terminates immediately
  • You must cease all use of the App
  • Premium purchases will be handled in accordance with purchase terms
  • Provisions that should survive termination will remain in effect

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to principles of conflict of laws.

Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.

Arbitration

If informal resolution fails, you agree that disputes will be resolved through binding arbitration in accordance with the rules of the Japan Commercial Arbitration Association.

Class Action Waiver

You agree to resolve disputes only on an individual basis and not as part of a class, consolidated, or representative action.

Apple-Specific Provisions

App Store Requirements

  • These Terms are between you and ProjectCam, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no warranty obligations regarding the App
  • Apple is not responsible for maintenance or support
  • Apple has no liability for any claims related to the App

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or deleted to the minimum extent necessary, and the remaining provisions will remain in full effect.

Waiver

Failure to enforce any right or provision of these Terms shall not be deemed a waiver of those rights.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ProjectCam regarding the App and supersede all prior agreements.
